Business Owner Of A Small Storage Company Essay - 1387 Words

Bailments As the business owner of a small storage company here in central Vermont I face many legal challenges. I have to create and use contracts to protect my business, and my customers. I maintain all of my facilities to provide an adequate storage facility to keep all customers items safe. I carry insurance to protect me, and my company, and I have even formed my business as a Limited Liability Company, (LLC) to help create liability protection for myself. However, a constant problem that I face as an owner of a storage company is bailments. Being a storage provider I am continuously creating bailments between my business and customers. The bailments I create are bailments for mutual benefit. The bailor stores his items in my facility with the expectation the facilities will be suitable and as described. In return my business, the bailee, will be compensated in accordance with the agreed upon price. My business deals with hundreds of bailments each year. To strengthen my business, and av oid litigation and legal suits involving bailments, I need to understand what a bailment is, how they work, and examine other legal cases involving bailments. A bailment is, a legal relationship in common law, where actual possession of personal property is transferred from one individual (Bailor), to another individual (Bailee). The bailee then has possession of the property. Bailments often are formed when an object or objects are given to someone for safe keeping.
